A. OVERVIEW
Northskills Polytechnic College, Inc. (hereinafter referred to as "NPCI") is committed to protecting the privacy and security of personal information in accordance with the Data Privacy Act of the Philippines. This Data Privacy Policy outlines the NPCI's policy related to the personal data that it collects, generates, uses, stores, retains, shares, discloses, transfers, or disposes.
NPCI respects your right to privacy and is committed to complying with the provisions of the DPA, its Implementing Rules and Regulations, and the relevant circulars of the National Privacy Commission (NPC). This Privacy Policy helps to ensure that all data processing activities of NPCI are compliant with the privacy principles of transparency, legitimate purpose, and proportionality as mandated by the DPA and its Implementing Rules and Regulations. Additionally, this Privacy Policy ensures that a balance is maintained between your right to privacy and NPCI's legitimate interests and the performance of its responsibilities as an educational institution.
In accordance with the Republic Act Number 10173, or the Data Privacy Act of 2012 (hereinafter referred to as DPA), the terms "personal data", "personal information", "sensitive personal information", and "privileged information" refer to any data that can directly or indirectly identify a specific individual. This data may include your information as a student, employee, or applicant for admission or employment.
B. DATA COLLECTION, GENERATION AND PROCESSING.
B.1. Purpose
NPCI collects and processes personal data for legitimate and specific purposes, including but not limited to student enrollment, written or electronic records, photographic imagery, digital content, biometric data, communication, and other educational activities related to you, from your own disclosures, from additional sources explicitly indicated by you, and for concerned government agencies.
B.2. Personal Data Collected
NPCI collects information, such as your name, email address, telephone number, citizenship, and other contact details. We may also collect data about your personal circumstances, such as your family history, previous schools attended, academic performance, disciplinary record, tax identification number (TIN) or Unified Multi-Purpose ID (UMID) number of parents, parent's name, address, and contact number, guardian's name, address, and contact number, and so on upon application for admission to NPCI, including the Competency Assessment, if applicable, such as:
your training schedules, completion forms, competency assessment activities and results, attendance record, etc.;
recorded or written testimonies, skill demonstration, community-based activities, immersion or Supervised Industry Learning;
attendance and/or membership in related organizations, seminars, competitions, programs; and
other forms of data in and for social media post, such as pictures or videos of activities you participate in, via official documentation of such activities, NPCI Campus Logbook, Accreditation, posting of Topnotchers and passers in related Examination or through recordings from closed-circuit security television cameras installed within school premises.
B.2. Other Data
NPCI may also collect other data for other related government agencies a third party, a publicly available source. In such cases, NPCI will exercise its sound discretion in determining whether or not it can legitimately keep those data. If said data are not related to NPCI’s legitimate interests as an educational institution, they will be immediately disposed of in a way that will safeguard your privacy. If the data are related to NPCI’s legitimate interests as an educational institution, they will be treated in the same manner as the information you provide the institution.
C. HOW WE USE YOUR PERSONAL DATA
NPCI is committed to using your personal data strictly in accordance with the Data Privacy Act of 2012 and its Implementing Rules and Regulations. Specifically, NPCI will only use your personal data if you have given your prior written consent, or if such use is necessary for the institution to fulfill its contractual obligations to you, comply with its legal obligations, protect your vital interests, including your life and health, respond to a national emergency, comply with public order and safety requirements as provided by law, or pursue its legitimate interests as an educational institution, which includes a variety of academic, administrative, historical, and statistical purposes.
D. HOW WE SHARE, DISCLOSE, OR TRANSFER YOUR PERSONAL DATA
NPCI will not share, disclose, or transfer your personal data without your written consent, except in the following circumstances:
When necessary to fulfill its legitimate interests as an educational institution, which includes a variety of academic, administrative, historical, and statistical purposes.
When necessary to perform its contractual obligations to you.
When necessary to comply with its legal obligations.
When necessary to protect your vital interests, including your life and health.
To respond to a national emergency or comply with public order and safety requirements as provided by law.
E. HOW PERSONAL DATA ARE STORED, RETAINED, AND DISPOSED OFF
NPCI stores your personal data in both hard copy and electronic formats. Only authorized NPCI personnel can access your stored personal data. NPCI retains your personal data only for declared, specified, and legitimate purposes. Some personal data may be retained indefinitely if necessary for NPCI to fulfill its contractual and legal obligations or pursue its legitimate interests. However, be assured that NPCI has organizational, physical, and technical security measures in place to protect your personal data.
If a retention period is provided by law or by applicable institutional policies, NPCI will dispose of your personal data in a way that prevents further processing, unauthorized access, or disclosure to any other party or the public, or that prejudices your interests.
F. YOUR RIGHTS WITH RESPECT TO YOUR PERSONAL INFORMATION
NPCI acknowledges your rights under the Data Privacy Act of 2012 and its Implementing Rules and Regulations, to the extent permitted by law. If you have any questions about your rights or this Policy, please visit the NPCI Office.
G. AMENDMENT OR REVISION OF THIS PRIVACY POLICY
NPCI may change this Privacy Policy at any time without giving you prior written notice, as long as the changes are consistent with the constitution, the Data Privacy Act of 2012 and its Implementing Rules and Regulations, and other applicable laws and regulations. Any changes to this Privacy Policy will take effect immediately upon their full publication on the NPCI campus.
If any part of this Privacy Policy is found to be illegal or inconsistent with data privacy law, the remaining parts of the Privacy Policy will remain in effect.
All other NPCI policies that are inconsistent with this Privacy Policy are hereby amended, revised, or superseded accordingly.
